PRIVACY POLICY

INTRODUCTION

This Privacy Policy (“Policy”) governs the processing of Personal Information by Zettuu (“We”, “Us”, “Our”, “Ourselves”) in accordance with applicable data protection laws and in connection with the Zettuu Platform. Your use of the Zettuu Platform is subject to this Policy. By using the Zettuu Platform, You give Your consent to the processing of Your Personal Information in accordance with this Privacy Policy. Accordingly, We encourage You to read this Policy carefully and contact Us with any questions or concerns in regard to Our Privacy practices.

We are committed to the principle of accountability in maintaining the privacy of Personal Information that You provide to Us when using the Zettuu Platform, as well as ensuring transparency between Ourselves and Yourself. This Privacy Policy describes how We treat Personal Information collected or received from You when You visit and engage with the Zettuu Platform.

Zettuu strongly believes in providing You with a Platform that respects Your privacy. This Policy will apply to how We handle Your Personal Information and You consent to Us collecting, using and disclosing Your Personal Information as detailed in this Policy. Given our concern for the privacy of children, it is our policy not to collect information from children under the age of 18 on our Platform. To access certain portions of this Platform, You will first be asked to provide Us with Personal Information, which We will do our utmost to protect. This Privacy Policy will help You understand how Zettuu collects, uses and discloses Your information. By accessing this Platform, You are consenting to the collection and the use of Your Personal Information by Zettuu, but only to the extent described in this Privacy Policy. As the terms of this Privacy Policy may be modified at Zettuu's sole discretion, without any obligation to notify you, We advise that from time to time you check this Platform to review the changes. Your continued use of this Platform shall constitute Your consent to any changes.

  1. DEFINITIONS

In this Policy the following definitions shall apply:

1.1    “Agreement” shall mean this agreement together with any schedules or amendments made from time to time in accordance with the provisions of this Agreement;

1.2    “Applicable Data Protection Laws” shall mean all legislation or regulations protecting the fundamental rights and freedoms of individuals in respect of their right to privacy with respect to the processing of personal information;

1.3    “Data Subject” shall mean any natural person in respect of whom the personal information relates;

1.4    “Guest” shall mean a shopper who does not register an account with Zettuu;

1.5    “Member” shall mean a shopper who has registered and activated an account with Zettuu

1.6     “Partner/s” shall refer to the entrepreneur companies (and its authorised representative/s) who use the Platform to display products for sale.  The authorised representative/s of Partners are Users on the Platform;

1.7    “Personal Information” shall mean any information relating to an identified or identifiable natural or juristic person (‘data subject’); an identifiable natural or juristic person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

1.8    “Post” shall mean the act of uploading, displaying, publishing, performing, distributing, transmitting, relaying or otherwise sharing User Content on the Platform;

1.9    “Third-Party” shall mean any other natural or juristic person that is not Guests, Members, Partners or Ourselves;

1.10   “User/s” shall collectively refer to Guests, Members, Partners and Third-Parties who register and make use of Zettuu;

1.11  “User Content” shall refer to all electronic information Posted or created on Zettuu, by one or more Users. For the purposes of this Agreement, User Content includes, but shall not limited to: data; text; messages, electronic files; images, videos, sounds, music, voice chats, or a combination thereof. User Content shall also include the content of a Third-Party.

1.12  “VAT” shall mean value added taxes as required by South African law but refers to the equivalent or similar tax in the relevant local country of a Guest or Member; and

1.13  “Zettuu” means Zettuu the e-commerce platform that showcases and sells African entrepreneurs’ unique products and services to a wider market. The Platform is owned and managed by Zettuu (Pty) Ltd (“Us, Our, Ourselves, We”).

  1. PERSONAL INFORMATION
  • Purpose For Collection And Processing

We primarily collect and process Your Personal Information to provide the products You requested from Us by using the Platform.  Purpose of collecting Personal Information:

  • Identification of the Users’ account;
  • Developing and improving the Services;
  • Facilitating direct communication between the Partners and Customers;
  • To facilitate Your purchase with our affiliated service providers;
  • To process, deliver, bill for, and collect payment for products purchased
  • Facilitating the shipping and delivery of the products to the Customer;
  • servicing Our relationship with You by, among other things, creating and maintaining a profile to enable Us to service You better or presenting options on the Platform that We think may interest You based on Your browsing;  
  • involving You in market research, gauging Your satisfaction with the Services and seeking feedback regarding Our relationship with You and/or the quality of service We have provided;   
  • To update you on changes to our Services or products, including new promotions.
  • for research and analysis in relation to Our business and the Services, including but not limited to trends in the sale of products and the success rate of sales of particular products;  
  • To anticipate and resolve problems with Our Service
  • to comply with Our legal obligations;
  • other purposes as authorised or required by law (e.g. to prevent a threat to life, health or safety, or to enforce Our legal rights); and
  • where required by law, specifically in response to a demand from government authorities where such demand meets the legal requirements.

Information from Third Parties: Some Members, You or Guests may choose to connect to Zettuu or register a Zettuu account using an external third-party application,  or an app developed using Zettuu API (where applicable). Zettuu may receive information from those connected third-party applications. 

Zettuu expressly acknowledges that We will not use any Personal Information for any other purposes without Your consent or as required by law. The Personal Information We collect will vary depending on how You are using the Platform, but may include Your name, address, email address, and telephone number.

  • Collection: What and How

WHAT: We collect Personal Information and other information relating to You, either as a juristic person - such as the business name, email address and business address of the Organisation – or as a natural person – such as Your email address, contact number and date of birth in Your capacity as a Customer. We may also collect other information, such as Your IP address, search terms, and site pages You visit whilst on the Platform. The technologies We use for this

automatic data collection may include cookies and log data. "). Such collection is performed by most webpages and will not allow You to be personally identified and you can disable such technologies. Credit card information is collected by the payment gateway company and not Us. We do not store financial information.  Except for the above, We do not collect any Personal Information unless You provide it voluntarily.

HOW: We collect Your Personal Information either directly or indirectly, including, without limitation: by registering a User account, by you submitting information to Us through the general email address, through our online registration form and using the Platform, by filling out a contact form or survey; by requesting information; by having an account and e-mail address with Us; by signing up for an e-mail newsletter, by otherwise communicating via e-mail.

  • Accuracy

You agree that any and all Personal Information that You provide to Ourselves is accurate. In the event that Your Personal Information contains any errors or inaccuracies, You agree to indemnify and hold Us, Our officers, directors, employees, agents, licensors, and members harmless from and against any claims, damages, actions and liabilities including without limitation, loss of profits, direct, indirect, incidental, special, consequential or punitive damages arising out of Our reliance on such Personal Information.

You must also let Us know immediately if You become aware that Your Personal Information has been provided to Us by another person without Your consent or if You did not obtain consent before providing another person's Personal Information to Us.

  • Processing Of Personal Information

The processing of Your Personal Information by Us shall include the collection, receipt, recording, organisation, collation, storage, updating or modification, retrieval, alteration, consultation, use; dissemination by means of transmission, distribution or making available in any other form; or merging, linking, as well as blocking, degradation, erasure or destruction of information.

We will only process Your Personal Information, where:

  • You have consented to such processing (which You may withdraw at any time by sending an email to info@zettuu.com;
  • The processing is necessary to provide the Services to You in terms of Our contractual relationship with Yourself;
  • The processing is necessary for compliance with Our legal obligations; and/or
  • The processing is necessary for Our legitimate interests or those of any Third-Party recipients that receive Your Personal Information - as detailed in the section below.
  • Further Processing: Who Do We Share Your Personal Information With And Why?

We do not and will not sell, rent out or trade Your Personal Information. We will only share Your Personal Information to third-parties in the manner set out in this Policy and in accordance with the Data Protection laws of the Republic of South Africa. Note that the term ‘share’ includes the act of ‘disclosing’; ‘transferring’; ‘sending’ or otherwise making Your Personal Information available or accessible to another person or entity.

We share Your Personal Information with Platform Partners or other third-parties so that We may deliver the Services. Zettuu may share demographic information with third parties, but it will be aggregated and de-personalised so that personal information is not revealed.

We share Your Personal Information with the following entities:

  • Logistics company– for courier services;
  • Integration Software company – for synching information from the Platform to our logistics partner; and
  • Payment gateway company – for processing payment.

Personal Information processed on the Platform will only be disclosed in accordance with the consent provided by Yourself.  Zettuu does not permit any of its Platform Partners or other necessary third-parties to use Your Personal Information for any other purpose than to perform the services that We have instructed them to provide. All processing is compatible with such purpose. You may consult the payment gateway company on the Platform in order to understand their Privacy Policy. We may share aggregated statistical information with third parties for advertising or marketing purposes. No Personal Information will be shared in this manner.

Other than the above, We will not disclose Your Personal Information without Your consent unless We reasonably believe that disclosure is necessary to lessen or prevent a threat to life, health or safety of an individual or to public health or safety or for certain action to be undertaken by an enforcement body (e.g. prevention, detection, investigation, prosecution or punishment of criminal offences), or where such disclosure is authorised or required by law (including applicable privacy / data protection laws).

  1. YOUR RIGHTS:

You may choose what Personal Information (if any) You wish to provide to Us. You also have the right to withdraw Your consent. However, if You choose not to provide certain details, or withdraw Your consent, Your experience with some, or all of the Platform features and/or Services, may be affected. To the extent required by law, You have certain rights in respect of Your Personal Information. In particular:

  • Withdrawal of Consent: You may withdraw Your consent at any time by sending a written request to info@zettuu.com. Upon receiving notice that You have revoked Your consent, We will stop using Your Personal Information within a reasonable time, which will vary depending on what information We have collected and for what purpose, and We will send You a confirmation email stating same.
  • Access Your Personal Information: You have the right to examine any of Your Personal Information that We collect. Should You wish to examine the information, please send Us a written request to info@zettuu.com. We reserve the right to charge You a reasonable administrative fee to access Your information.
  • Update, Modify, Rectify, Erase or obtain a Copy of the Personal Information that We hold on You; and
  • Object to the processing of Your Personal Information or Restrict or stop Us from using any of the Personal Information which We hold on You, including by withdrawing any consent You have previously given to the processing of such information;

These rights are not absolute, and We therefore reserve the right to refuse any requests in terms of the above-mentioned rights, for any reason permitted under South African data protection laws.

In the event that You wish to enforce any of the above rights, You can request this by emailing Us at info@zettuu.com.

You also have the right to lodge a complaint with the South African Information Regulator.

  1. SECURITY OF INFORMATION

We are committed to safeguarding and protecting Your Personal Information and will implement and maintain appropriate technical and organisational measures to ensure a level of security appropriate to protect any Personal Information provided to Us from accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to Personal Information transmitted, stored or otherwise processed. We have implemented various physical, electronic and managerial security procedures in order to protect the Personal Information We hold from loss and misuse, and from unauthorised access, modification, disclosure and interference – such procedures are regularly reviewed. We will destroy or de-identify Personal Information once We no longer require it for Our business purposes, or as required by law.

  1. HOW LONG DOES ZETTUU RETAIN YOUR PERSONAL INFORMATION?

Zettuu retains Personal Information for the period necessary to fulfil the purposes outlined in this Privacy Policy. When determining how long to retain Personal Information, We take into account the necessity of the Personal Information for the provision of the Services, the Platform or other Third-Parties such as payment processors, as well as applicable laws, regulations and legal obligations.  We may also retain records to investigate or defend against potential legal claims. 

When retention of the Personal Information is no longer necessary, the information will either be deleted or aggregated for analytic purposes, in which case We will de-identify Your Personal Information.

  1. THIRD PARTY WEBSITES

We provide links to websites outside of our Website, as well as to third party websites. These linked sites are not under our control, and we cannot accept responsibility for the conduct of companies linked to our Website. Before disclosing your Personal Information on any other website, we advise you to examine the terms and conditions of using that website and its privacy policy.

We may change this Policy at any time, in which case any amended terms shall be effective immediately upon the posting of the revised Policy and any subsequent activity in relation to the Zettuu Platform shall be governed by such amended terms. We therefore recommend that You check Our Website regularly. If You do not agree with any term in this Policy, please do not use the Zettuu Platform.
